Blandy & Blandy achieves notable success

Blandy & Blandy’s Family Law team recently secured success in the FAZ v MAZ case with significant implications for family law costs orders where abuse allegations are involved
Blandy & Blandy’s leading Family Law team has recently achieved a significant victory following the publication of a follow-up judgment concerning costs in the intricate case of FAZ v MAZ & Anor. This case highlights the complexities involved in private law children proceedings, particularly when allegations of sexual abuse arise. Earlier in the year, the firm had represented the father in an essential ruling by The Honourable Mr Justice Poole, which found that the accusations against him were unproven. This initial judgement, FAZ v MAZ (Private Law: Allegations of Sexual Abuse of Child) [2026] EWFC 131, provided crucial findings that enabled efforts to restore familial relationships.
Elizabeth Owen, an associate in Blandy & Blandy's specialist Family Law team, played a pivotal role in the case, collaborating with Janet Bazley KC and Lucy Sprinz of 1GC Family Law. Together, they successfully advocated for the father during the substantive judgments which laid the groundwork for a positive path forward. In the recent costs judgement ([2026] EWFC 301), delivered on 19 October 2026, the Court reflected on the mother's behaviour related to the allegations to assess whether it warranted a deviation from the customary practice where each party typically bears their own costs. Mr Justice Poole remarked that certain aspects of the mother's conduct were unreasonable, resulting in an order for her to contribute to the father's legal expenses.
This ruling offers invaluable clarification regarding the principles that govern costs orders in private children law cases, particularly when allegations of abuse are determined to be frivolous or vexatious, leading to unnecessary litigation. By analysing the interplay between conduct and legal costs, the judgement reinforces the importance of responsible legal claims in family law contexts. Blandy & Blandy continues to be recognised as a top-tier firm for Family Law, boasting accolades from both the Chambers UK Guide and The Legal 500. Their specialist team remains dedicated to providing insightful guidance across all areas of Family Law.
