Attorney General takes Fordingbridge cases to appeal

The Attorney General has referred the Fordingbridge Three cases to the Court of Appeal for review
The Attorney General has opted to refer the cases of the Fordingbridge Three to the Court of Appeal following a thorough examination initiated by increasing public concern. This decision follows multiple requests for a review of the original sentences, prompting the Attorney General’s Office to delve into the details surrounding the case, which included the judge’s findings and the applicable sentencing guidelines. A reference under the Unduly Lenient Scheme is applicable when a sentence is not merely lenient but is perceived as unduly so.
The Court of Appeal is now tasked with determining the appropriateness of the initial sentences and deciding whether they warrant an increase. Attorney General Richard Hermer KC acknowledged the significant public interest surrounding this horrific case, stating “There has understandably been a huge amount of public interest, and concern, at this horrific case.” He expressed urgency in his review process, saying “I directed my officials to work urgently, to allow me to consider this decision swiftly, and to begin to bring closure to the victims and their families.”
Hermer noted the considerable bravery displayed by the victims, stating “It is clear to me from their powerful personal statements, that these girls have displayed immense bravery in coming forward.” He underscored the ongoing issue of violence against women and girls in the UK, asserting that “this government will not hesitate in taking action to ensure all women and girls feel safe and have confidence in the justice system.”
For those interested in challenging lenient sentences, it is important to note that anyone can ask for a review of a Crown Court sentence, provided it falls under permitted categories such as murder or rape. Moreover, victims and bereaved families are afforded a generous timeframe of six months to seek reconsideration of sentences, as opposed to the standard 28 days typically allowed for general reviews. Detailed information regarding the Unduly Lenient Scheme can be found on the government’s website.
