Fox Williams represents client in £15m lawsuit

Fox Williams is representing former Coller Capital executive Chris McDermott-Spencer in a significant High Court claim regarding carried interest entitlements linked to numerous Coller Capital funds
The claim, exceeding $15 million, alleges that Mr McDermott-Spencer reached an agreement with Jeremy Coller, the firm's founder, regarding an allocation of carry from one of the flagship funds. In return for his commitment to remain with Coller Capital for an additional 18 months, he sought to preserve his existing carry entitlements. This proceeding is notable, as it has been filed against both Coller Capital, which has been acquired by EQT AB, and Mr Coller himself, with the trial scheduled for 16 November 2026.
The case highlights broader issues impacting the private equity sector, particularly around authority within the organisation, and the practicalities surrounding carry allocation processes. It also raises essential questions about how decisions regarding senior executive remuneration are made in firms led by their founders. The team at Fox Williams, led by disputes Partner David Butler, includes Senior Associate Olwen Mair and Associate Anouska Royle.
In discussing the significance of this matter, David Butler remarked that "disputes involving executive remuneration and incentive arrangements are often among the most significant and complex issues faced by senior individuals and businesses." He further noted that the claim revolves around "valuable, carried interest entitlements in the private capital sector," expressing anticipation for presenting their client's case in court.
