Consultation on sentencing guidelines begins

The Sentencing Council invites public feedback on amendments to sentencing guidelines following the Sentencing Act 2026
The Sentencing Council is currently consulting on proposed amendments to the Imposition guideline in light of the Sentencing Act 2026, which received Royal Assent on 22 January 2026. The act brings significant changes to the sentencing framework in England and Wales, as well as updates to the law regarding the release and supervision of individuals serving custodial sentences. In its commitment to reflect these new provisions, the independent Sentencing Council is seeking input on the revised guidelines for community and custodial sentences, in accordance with its statutory obligations.
Open to a diverse range of participants, the consultation encourages contributions from the public, judiciary members, legal professionals, and others with an interest in the criminal justice system. The consultation period runs from 10 June to 2 September, offering ample opportunity for stakeholders to engage in the process.
An embargoed copy of the consultation paper can be requested, while the online version will be available from 00:01 on 10 June. The aim of this initiative is to implement legislation that received royal assent earlier this year. The language of the proposed amendments has been carefully crafted to align with the provisions of the Sentencing Act 2026.
The Sentencing Council operates as an independent entity, accountable to Parliament and subject to oversight by the Justice Select Committee. Justice Ministers bear responsibility for the Council's effectiveness, efficiency, and financial conduct, ensuring its independence is safeguarded. Judicial Council members are appointed by the Lord Chief Justice with the Lord Chancellor’s agreement, while non-judicial appointees are selected by the Lord Chancellor in consultation with the Lady Chief Justice.
