AND A TICKET HOME
By Nicola Laver
A wife's inheritance claim was rejected because it was made more than six months after probate was granted. Rosita Hendry from the Philippines married Michael Hendry, who was 20 years her senior, in 2003. She had signed a pre-nuptial agreement limiting a claim to £10,000 and a flight home if they split up. The marriage did not last and, during the divorce process, Michael died leaving his estate to his two children and nothing to Rosita. They offered her a third of his £220,000 estate but her claim for half of it was refused by the High Court for being out of time, even though it had merit. 3 July 2019
