Battling the threat to expert evidence

The government has 
launched a raft of legislation and consultations in an attempt to radically reduce court costs, including those generated by experts. But while many believe the cut backs are too extreme, in 
the short term experts will have to adapt their practices to make their work pay.

Expert shopping discouraged

A recent decision by the Court of Appeal refusing the claimant to adduce further expert evidence after the expert he originally instructed failed to establish a link between his condition and his work activities will make it more difficult for future claimants to have additional experts appointed later on in court proceedings.
